Unprecedented, President Joe Biden Pardons Son Hunter, Citing Miscarriage of Justice and Political Bias
In a historic and deeply personal decision, President Joe Biden announced on Sunday, December 1, that he has granted a full and unconditional pardon to his son, Hunter Biden. The move absolves Hunter of all federal charges, including those related to a 2018 firearm purchase and tax evasion accusations, marking a significant reversal of Biden's earlier pledge to not intervene in his family’s legal matters.
A Reversal of Promises
President Biden’s decision comes after years of public assurances that he would not use his presidential powers to shield family members from legal consequences. During his presidency and campaign, Biden consistently emphasized his commitment to upholding the rule of law and allowing the Justice Department to operate independently.
However, in a statement released by the White House, the President justified his actions by accusing his political opponents of weaponizing the legal system against his family. "From the day I took office, I said I would not interfere with the Justice Department’s decision-making, and I kept my word even as I watched my son being selectively and unfairly prosecuted," Biden said. "But this weekend, I concluded that raw politics had infected this process, leading to a miscarriage of justice."
Legal and Political Context
Hunter Biden, a recovering drug addict who has openly acknowledged his past struggles, was facing up to 25 years in prison for firearm-related charges and up to 17 years for tax-related offenses. In June 2023, he was convicted on three felony counts for making false statements on a federal gun form, concealing his drug addiction while purchasing a firearm.
Additionally, he had pleaded guilty to failing to pay over $1.4 million in taxes on time, though he later resolved the debt with interest and penalties. These charges became a focal point for Republican criticism, with many alleging corruption within the Biden family.
President Biden pointed to these attacks as evidence of selective prosecution, arguing that his son was targeted due to his family ties. "No reasonable person who looks at the facts of Hunter’s cases can reach any other conclusion than Hunter was singled out only because he is my son," Biden asserted. The pardon also extends to any other offenses Hunter may have committed between January 1, 2014, and December 1, 2024, effectively ending all pending legal proceedings against him. This decision comes just weeks before Hunter’s sentencing and amid heightened political tension as President-elect Donald Trump prepares to assume office in January 2025.
Selective Prosecution and Political Fallout
The President did not mince words when describing the political undercurrents behind his son’s legal troubles. He accused Republican lawmakers of instigating investigations to undermine his presidency. "The charges in his cases came about only after several of my political opponents in Congress instigated them to attack me and oppose my election," he said.
Biden also criticized the collapse of a plea deal Hunter had negotiated with the Department of Justice earlier this year, blaming political interference for the agreement's unraveling. "Had the plea deal held, it would have been a fair, reasonable resolution of Hunter’s cases," Biden remarked.
This move, however, risks further polarizing an already divided political landscape. Republicans, including former President Donald Trump, have frequently pointed to Hunter Biden’s legal issues as evidence of systemic corruption within the Biden administration. The pardon is likely to intensify such criticism.
Hunter Biden’s Reaction
Hunter Biden expressed gratitude for his father’s intervention, acknowledging the controversies surrounding his legal troubles. "I have admitted and taken responsibility for my mistakes during the darkest days of my addiction," Hunter said in a statement. He pledged to dedicate his life to helping others struggling with substance abuse and vowed not to take the pardon for granted.
Hunter, who has been sober for over five years, described the relentless scrutiny and legal battles as a painful chapter in his recovery journey. "My past mistakes have been exploited for political purposes, but I remain committed to my personal growth and sobriety," he said.
A Father’s Defense
President Biden’s decision was as much about his role as a father as it was about his presidency. He framed the pardon as an act of justice and compassion, one rooted in his belief that his son was treated unfairly. "There has been an effort to break Hunter – who has been five and a half years sober, even in the face of unrelenting attacks and selective prosecution.
In trying to break Hunter, they’ve tried to break me," Biden said. "Enough is enough." The President made the decision during the Thanksgiving holiday weekend, which he spent in Nantucket with his family. "As I wrestled with this, I realized there was no sense in delaying it further," Biden stated. "I hope Americans will understand why a father and a President would come to this decision."
Historical Precedent
While unprecedented in its personal nature, Biden’s use of the presidential pardon is not without precedent. Former President Donald Trump similarly pardoned close allies and associates during his tenure, including his son-in-law Jared Kushner’s father, Charles Kushner. However, Biden’s move stands out for its familial dimension and the stark contrast to his earlier promises.
President Biden’s pardon of his son Hunter is likely to spark intense debate over the intersection of justice and politics. While Biden insists his decision was motivated by fairness and the need to correct a miscarriage of justice, critics will undoubtedly view it as a breach of his earlier commitments. As the political fallout unfolds, the pardon marks a significant chapter in both Biden’s presidency and his personal life, highlighting the challenges of balancing familial loyalty with public accountability.
