'..merely prosecuting individuals...', says top court on child marriage related petition

The Supreme Court of India has called for an intersectional approach to address child marriage, issuing guidelines to enhance the enforcement of the Prohibition of Child Marriage Act. A recent petition by the NGO "Society for Enlightenment and Voluntary Action" pointed out the inadequate enforcement of child marriage laws, leading to the continued marriage of millions of girls before the age of 18 due to socio-economic factors.

Supreme Court of India has said that addressing child marriage requires an intersectional approach especially when dealing with girl child. Delivering judgement on a Public Interest Litigation alleging rise in child marriages in the country, the Supreme Court issues a slew of guidelines for effective implementation of the law on the prevention of child marriages.

A petition had been submitted by the NGO "Society for Enlightenment and Voluntary Action," which contends that the Prohibition of Child Marriage Act, established in 2006, is not adequately enforced, allowing child marriage to continue in various regions. Despite the legal restrictions, reports suggest that millions of girls are married before reaching the legal age of 18, often due to socio-economic pressures.

A bench consisting of Chief Justice of India DY Chandrachud, Justice PS Narasimha, and Justice JB Pardiwala is set to deliver the verdict. During the last hearing, the Supreme Court urged the Centre to ensure the appointment of child marriage prohibition officers in every district and instructed it to outline the policy measures taken to enforce the Prohibition of Child Marriage Act. The Supreme Court emphasized in July, while reserving its verdict on the Public Interest Litigation (PIL) filed by the NGO, that merely prosecuting individuals involved in child marriages will not address the underlying social issues.
