Impeachment Motion Filed Against Allahabad High Court Judge Justice Shekhar Yadav

Justice Shekhar Yadav

A group of 55 Rajya Sabha MPs, led by senior advocate and MP Kapil Sibal, has submitted an impeachment motion against Allahabad High Court judge Justice Shekhar Yadav to the Secretary General of the Rajya Sabha.

The motion alleges that Justice Yadav's controversial remarks at a Vishwa Hindu Parishad (VHP) event incited communal animosity and violated the secular ethos of the Indian Constitution.

The Controversial Remarks

Justice Shekhar Yadav sparked criticism with his statement that "the country’s laws should operate in accordance with the majority community" and his use of the term "kathmulla" while referring to Muslims. These remarks have drawn sharp reactions from political and legal circles, with opposition MPs accusing him of misusing his judicial position to promote divisive ideologies.

Political and Legal Reactions

The impeachment motion has created a stir in both political and legal communities. Opposition parties are demanding strict action against Justice Yadav, asserting that his remarks undermine the judiciary's impartiality and constitutional values.

Changes to Justice Yadav's Judicial Responsibilities

In light of the controversy, the Allahabad High Court recently issued a new roster for Justice Yadav, restricting him to hearing cases filed before 2010 and appeals from lower courts. Sensitive matters such as bail and rape cases, which he previously handled, have been reassigned.

Questions Over the Roster Change

The sudden change in Justice Yadav’s judicial assignments has raised questions about whether it is a response to the controversy. While the Allahabad High Court has not issued an official statement on the matter, the Supreme Court has sought information regarding the developments, adding further sensitivity to the situation.

The impeachment process now awaits further proceedings in the Rajya Sabha. If taken forward, the motion could mark a significant step in addressing alleged misconduct within the judiciary. Meanwhile, all eyes are on the Supreme Court and the Allahabad High Court for their stance on the matter.

This ongoing controversy highlights the delicate balance between judicial independence and accountability, raising important questions about the role of the judiciary in upholding constitutional values.

Rajya Sabha MP Kapil Sibal says, "We have given a notice to the Rajya Sabha Secretary General to impeach Allahabad High Court judge, Justice Shekhar Kumar Yadav. He had given an inflammatory speech on December 9 at the High Court premises...We believe that the judge has no right to hold that post and he should be removed...We have moved a motion to remove the judge...This is not a political issue but an issue of protecting the Constitution and the independence of the judiciary. We urge Prime Minister Modi, Union Home Minister Amit Shah and leaders of the ruling party to join us in protecting the Constitution...The Supreme Court should also order the removal of the judge and he should not be assigned any work until a decision is taken on the motion...55 MPs have signed the motion..."
