BJP’s Navya Haridas Challenges Priyanka Gandhi’s Wayanad By-Election Victory in Kerala High Court

Bharatiya Janata Party (BJP) leader Navya Haridas has filed a petition in the Kerala High Court, contesting the recent electoral victory of Priyanka Gandhi Vadra in the Wayanad Lok Sabha bypolls held on November 13. Haridas, who finished third in the election, lost to the Congress leader by a margin of 5,12,399 votes.

Allegations Against Priyanka Gandhi

In her petition, Haridas has alleged that Priyanka Gandhi’s nomination papers violated election laws. She claimed that the Congress leader:

Suppressed vital information regarding assets owned by her and her family.

Misguided and misinformed voters to influence their electoral choices.

Engaged in corrupt practices as defined under the Representation of the People Act, 1951.

Exercised undue influence over voters during the election process.

The petition seeks to nullify Priyanka Gandhi’s election victory, alleging that her nomination violated the Model Code of Conduct and election rules.

Legal Representation and Hearing Date

Advocate Hari Kumar G. Nair, representing Haridas, emphasized the petition’s objective to address alleged discrepancies in Gandhi’s nomination and electoral conduct. The Kerala High Court is scheduled to hear the case in January 2025, as it will remain on vacation from December 23 to January 5.

Priyanka Gandhi’s Landmark Victory

Priyanka Gandhi’s victory in the Wayanad bypoll marked her debut as an elected representative, securing 6,22,338 votes. Her win surpassed her brother Rahul Gandhi’s victory margin in the April 2024 general elections but fell short of his 2019 margin. The bypoll was necessitated after Rahul Gandhi vacated the seat earlier this year.

Priyanka’s entry into Parliament is seen as a significant milestone in her political career, nearly two decades after she first campaigned in the 2004 Lok Sabha elections. Her win is also viewed as a boost for the Congress party, particularly in Kerala, as it seeks to strengthen its position nationally.

BJP’s Response

Reacting to the petition, BJP spokesperson Shehzad Poonawalla said: “Not only the BJP but even her communist companions in Delhi are questioning her victory. They have alleged support from organizations like Jamaat-e-Islami, and Congress’s behavior resembled that of the Muslim League, crossing all limits of appeasement politics. Everything will be proved in court.”

The legal challenge comes as Priyanka’s victory is celebrated as a key moment for the Congress party, reflecting its growing foothold in Kerala. However, the allegations and pending court proceedings may impact her debut term as an elected representative.
