BIG MOVE, Centre extends extensive powers to Lt Governor, in Delhi
India's Ministry of Home Affairs has notified that the President has delegated new powers to the Delhi Lieutenant Governor (L-G). The L-G now has authority to form and appoint members to any authority, board, commission, or statutory body under laws enacted by Parliament for Delhi.This decision centralises more power with the L-G, impacting governance structure of Delhi.
This is indeed a significant development for Delhi's administrative structure, as the Union Home Ministry has granted the Lieutenant Governor (LG) of Delhi extensive new powers. This move centralizes the authority to establish and oversee various statutory bodies and commissions, including entities like the Delhi Commission for Women and the Delhi Electricity Regulatory Commission.
According to the recent notification, the LG is now empowered to create and manage these authorities, boards, and commissions independently. This includes the power to appoint members to these bodies, a responsibility previously shared with or managed by other governmental entities.
The notification, issued in accordance with Article 239 of the Constitution and Section 45D of the Government of National Capital Territory of Delhi Act, 1991, marks a major shift in Delhi's administrative oversight. It stipulates that the LG, under the President's directive and control, will exercise the powers to establish and appoint members to any statutory body or commission. This change consolidates the authority to both form and staff these bodies within the LG’s office, significantly altering the previous collaborative approach with the Delhi government.
In essence, this new directive centralizes decision-making power regarding the constitution and management of statutory bodies in Delhi, granting the LG substantial autonomy in these processes.
