Accused Who Shouted "Pakistan Zindabad" Given a Unique Punishment of 21 Salutes to the Indian National Flag

In a significant case from Madhya Pradesh's Raisen district, an individual accused of shouting pro-Pakistan slogans has been ordered to chant "Bharat Mata ki Jai" as a form of punishment. The accused, Faisal (also known as Faizan), reportedly made pro-Pakistan statements, leading to an FIR filed against him at the Misrod police station in Bhopal on May 17, 2024. After the investigation, a charge sheet was presented in the trial court. The Madhya Pradesh High Court has now granted him conditional bail for a bond of ₹50,000.

As part of his bail conditions, the accused is required to salute the national flag and chant "Bharat Mata ki Jai" on the first and fourth Tuesday of every month, from 10 AM to 12 PM, until the case is resolved. Any violation of these terms could result in the revocation of his bail.

The Bhopal Police Commissioner has been instructed to monitor the compliance of these conditions, and video documentation of the salutes is also mandated.

According to the High Court's order, the accused must appear at the Misrod police station during the specified times, where he is to salute the national flag 21 times while chanting "Bharat Mata ki Jai." This stipulation will be included in the bail documents and will remain effective until the conclusion of the case. However, if he violates any of these terms, the bail will become invalid. A copy of this order will be sent to the Police Commissioner to ensure adherence to the outlined conditions.

The High Court's ruling came after Faisal was arrested under Section 153 of the IPC for allegedly promoting enmity between different groups by shouting "Pakistan Zindabad" and "Hindustan Murdabad." Faisal was taken into custody by the Misrod police on May 17, 2024, after the incident.

In his bail plea, Faisal claimed he was falsely implicated. However, the prosecution presented video evidence showing him making the controversial statements, and it was noted that he has a criminal background with 14 prior cases against him.

Taking all evidence into account, the High Court granted conditional bail, stipulating that Faisal must comply with the outlined requirements of saluting the national flag and chanting "Bharat Mata ki Jai." The responsibility of ensuring compliance with these conditions has been assigned to the Bhopal Police Commissioner.
